• Definition of 'Agreement for Sale' Definition: An agreement for sale constitutes the terms and conditions of sale of an immovable by the Transferor to the Transferee.
• An agreement For sale is a legal document that outlines the terms of a real estate transaction. It lists the price and other details of the transaction, completion date for the transaction, and is signed by the Transferor and the Transferee.
• An agreement for sale, is an agreement to sell a property in future. This agreement specifies the terms and conditions, under which the property in question will be transferred. The Transfer of Property Act, 1882, which regulates the matters dealing with the sale and transfer of house property, defines the contract for sale or an agreement for sale as under:
• “A contract for the sale of immovable property, is a contract that a sale of such property shall take place on the terms settled between the parties” the Agreement shall be always subject to the Provisions of the Maharashtra Ownership of flats (Regulation of the Promotion of Construction, Sale, Management & Transfer) Act, 1963 & Rules 1964.
• In case of failure of the seller to sell or hand over possession of the property to the buyer, the buyer gets a right of specific performance, under the provisions of the Specific Relief Act, 1963. A similar right is available to the seller under the agreement, for seeking specific performance from the buyer.
• From the above definition, it becomes amply clear that an agreement for sale contains a promise to transfer a property in question in future, on satisfaction of certain terms and conditions. So, this agreement itself does not create any rights or interest in the property, for the proposed buyer.
• Sale Deed is a legal document describing the transfer of right, title and ownership of Property by a Seller to a Purchaser at a price either fully paid up as mentioned in the Previously executed Agreement for Sale between the parties.
• The Sale Deed can be also drafted and executed to purchase an Immovable Agreement in case the entire amount of sale transaction also known as sale consideration is paid at the time of registration of Sale Deed.
• Sale deed is the document prepared at the time of full payment made by the buyer and when the actual transfer of the property takes place.
• “Power of attorney,” is legal Document wherein you give another person authority to handle your personal business and make decisions on your behalf. A person creates the power of attorney for use when he is incapacitated or otherwise unable to handle his own affairs.
• A grant of power of attorney legally gives a person the authority to perform acts for another person in business dealings, legal matters and other issues. The person who is authorizing the other individual to act on his behalf is known as the principal.
• A power of attorney is a document you can use to appoint someone to make decisions on your behalf. The person you designate is called an "attorney-in-fact." The appointment can be effective immediately or can become effective only if you are unable to make decisions on your own.
• Power of attorney,” must Be Registered Compulsory at Nearest SRO- Sub Registrar Office (Notary Of Power of Attorney is not Considered Valid)
• A leave and license agreement is an agreement wherein the licensor temporarily allows the licensee to use and occupy licensor's immovable property, for the purpose of carrying business activity or residential use. For this, the licensor shall be paid by the licensee a fixed amount also known as the Monthly Compensation / Rent / Licence Fee.
• The leave and license are usually granted to the licensee for a period of 11 months or 12 Months.
• The Maximum Tenure for Leave & Licence Agreement can Be 60 Months (i.e. 5 Years)
